PALM BEACH COUNTY, FL (BocaNewsNow.com) (Copyright © 2022 MetroDesk Media, LLC) – AVIS Car Rental is facing a major lawsuit in Palm Beach County after a man, retrieving luggage from the back of his Ford Mustang, rented, was seriously injured as the AVIS agent drove away without seeing the man partly in the car.
According to the just-filed lawsuit, Kenneth Mass was returning the rented Ford Mustang to the AVIS location near Palm Beach International Airport on June 22, 2021. That’s when the employee Anonymous from AVIS apparently didn’t look around the car after checking it in.
Mass was partially in the trunk, pulling out his luggage, when the AVIS driver took off in the Mustang. The lawyers wrote:
“AVIS drove the subject vehicle negligently; did not observe that the plaintiff was retrieving luggage from the trunk; carelessly and negligently moved the car while the trunk was open; failed to train (the employee) in a safe and careful manner to accept a rental return; and did not properly wait for the trunk to be closed before moving the car.
As a result of AVIS’s alleged negligence, “plaintiff’s arm was pulled by the subject vehicle and sustained bodily injury resulting in pain and suffering, disability, disfigurement and mental anguish”. Mr. Mass, according to the suit, had to undergo surgery on his shoulder.
The suit, filed by attorney Lambros Lambrou in Fort Lauderdale, seeks more than the legal minimum of $30,000. AVIS has not yet filed a response.
